AIRA‘s Annual Advanced Restructuring and Plan of Reorganization Conference (“POR”) in New York is a one-day educational forum, focusing on the legal and financial perspectives of recent developments in bankruptcy, insolvency and restructuring activities. The program is geared toward maximizing opportunities for learning and networking, as well as offering credit for continuing legal and professional education. POR is a hybrid event, offering attendees a live, in-person experience and a virtual option for those who choose to attend from home or office.

The Impact of Purdue

During this session, our panel will: explain the Supreme Court decision in Purdue Pharma; discuss the possible impact of the Purdue Pharma decision on future business reorganizations; and, analyze the Constitutional issues that will come into play if Congress decides to amend the Bankruptcy Code to provide limited third-party releases or if there are challenges to the current statutorily allowed third-party releases in asbestos bankruptcies.

What You Must Do When Your Client Lies to You (Ethics)

Legal counsel, financial advisors, CPAs and bankers face hard choices-not only between right and wrong, but also between right and right. For example, it is "right" for a professional to be loyal to a client; but it is also "right" for a professional to protect others from harm, for lawyers to serve conscientiously as an officer of the legal system, and for lawyers and other professionals in the bankruptcy system to pursue justice.  When the two "rights" conflict with each other, how should the lawyer, financial advisor, CPA or banker choose?  Different professionals may have different obligations and be bound by a code of professional responsibility (if they have one). The panel will address the thorny issues for professionals who are forced to deal with a client who has been less than forthcoming or is intending to take an action that is a “problem.”
