Matt Smith (CPA, CIRA, CDBV) is a managing director at FTI Consulting.  He has 18 years of experience in insolvency and commercial litigation, business valuation, and corporate restructuring.  His engagements are spread across a wide range of industries including telecommunications, cryptocurrency, utilities, healthcare, retail, financial services, professional sports, and direct-to-consumer marketing industries.

Matt is proficient in preparing analyses to determine solvency or damages involving breach of contract, breach of fiduciary duty, fraudulent conveyances, preferential transfers, and shareholder disputes.  He oversees all aspects of litigation engagements including identifying potential claims, developing liability and damage theories, assisting in discovery, completing industry research, preparing affirmative and rebuttal reports and related analyses, providing deposition and trial testimony, and negotiating settlements.

Matt also leads clients through Chapter 7 and 11 bankruptcies and out-of-court restructurings including debtors, unsecured creditors’ committees, trustees, secured lenders, and equity committees.  He has prepared first day motions, DIP budgets, 13-week cash flow projections and variance reports, bankruptcy schedules and statements of financial affairs, long-term business plans, liquidation analyses, and plans of reorganization.

Adelphia Communications - Normalized Adelphia’s three-year financial restatement and prepared valuation of $1.1 billion asset sale

Core Scientific - Analyzed proposed business plan and negotiated plan valuation allowing equity to maintain majority ownership of reorganized entity

HealthSouth Corp - Analyzed financial restatement and prepared an expert report to support reasonably equivalent value in connection with transactions totaling $400 million

Tyson v Marfrig -   Defended alleged damages related to a put option provision as part of a $2.4 billion transaction

MF Global - Prepared valuation supporting $2.0 billion of damages resulting from management’s strategy of investing in European RTM securities

Nine West - Prepared expert report critiquing the financial projections and valuations prepared as part of a $2.0 billion LBO

Sears - Recast multi-year financial projections for solvency analyses at the time of several historical transactions ($125 million settlement)

Ultimate Fighting Championship - Prepared an expert report demonstrating the UFC’s ability to increase fighter compensation during a six-year period
